Can I ask for the Respondent's response to be struck out?

Yes. The same rules apply to Respondent's claims and conduct as apply to yours.

You will need to make an application to the Tribunal for the strike out and send a copy of that application to the Respondent. The application should be clear and focused on what part of Rule 38 you say has been broken.
