What evidence do I need to Claim injury to feelings?

To win any injury to feelings award, you must prove not just the discriminatory act but also its emotional effect on you.

Contemporaneous diary entries and notes

Record incidents promptly—capture what was said or done and how it made you feel. Notes written soon after the event carry weight.

Messages, emails and written communications

Keep copies of discriminatory or harassing emails, texts, WhatsApp messages, or grievance correspondence. These show the nature and timing of the mistreatment.

Witness statements

Lay out incidents clearly, explain in your statementn the emotional response (e.g., “I cried,” “I stopped sleeping”), and describe how it affected your life. Colleagues, friends, or family can attest to what happened and its impact. For example, a friend might confirm: “She was visibly shaken after the meeting"

Professional evidence

Notes from your GP, therapist, or counsellor describing stress, depression, anxiety and treatments, go to show the impact it had on you.

You will need to write a detailed account of your evidence before the Final Hearing and possibly any Preliminary Hearing, and send it to the other side.

🏛️ Final Hearings

This is when your case is decided by the tribunal.
