What is a witness statement in the
​employment tribunal?

Understanding the Purpose of a Witness Statement

A witness statement in the employment tribunalis your written version of the facts you want the tribunal to hear. It's not about arguing your case—it’s a personal, factual account of what you saw or experienced, and it helps the tribunal understand was is said to have happened.

Tips to Keep Your Witness Statement Effective

Use Plain Language
Write as you speak—avoid legal jargon. Speak plainly so someone with no legal training can understand

Stay Focused
Stick to factual detail that relates to your claim. Don't ramble about unrelated events or feelings.

Keep It Concise
Aim for an appropriate length—long enough to cover issues clearly, not so long that it's dense or off-topic.

Once the claim has started get the roadmap for your case at a Case Management Hearing ("CMH").

The CMH may identify specific issues to resolve before a Final Hearing, like strike-out or employment status.

📂 Disclosure

You will be ordered to exchange all relevant documents with the other side.

🗣️ Witness Statements

You will need to write a detailed account of your evidence before the Final Hearing and possibly any Preliminary Hearing, and send it to the other side.

🏛️ Final Hearings

This is when your case is decided by the tribunal.

If you win, this stage decides compensation or reinstatement
